民间借贷利率司法保护大幅下调，逼近城投非标产品收益

8月20日，最高人民法院发布新修订的《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》(以下称《规定》)。《规定》修改了民间借贷利率的司法保护上限，即以中国人民银行授权全国银行间同业拆借中心每月20日发布的一年期贷款市场报价利率(LPR)的四倍为标准，取代原来的“以24%和36%为基准的两线三区”。

以2020年7月20日发布的一年期贷款市场报价利率3.85%的4倍计算，当前的民间借贷利率的司法保护上限为15.4%，相较于过去的24%和36%有较大幅度的下降。

大幅度降低民间借贷利率的司法保护上限，主要有以下几个方面的原因：

一是经济社会发展的客观要求。降低中小微企业的融资成本，引导整体市场利率下行，是当前恢复经济和保市场主体的重要举措。二是规范民间借贷活动的客观需要。三是确保民间借贷平稳健康发展的需要。民间借贷作为国家正规金融的必要补充，不得违反法律，不得违背公序良俗。四是推动利率市场化改革的必然要求。过高的利率保护上限不利于营造利率市场化改革的外部环境，也不符合利率市场化改革的方向。五是统一司法裁判标准的现实需求。有必要顺应经济发展的趋势，适时对民间借贷司法解释进行修订，给民间借贷纠纷提供更为具体明确的裁判标准和救济渠道。

民间借贷利率的司法保护上限也不是越低越好。长期以来，关于利率的司法保护上限一直是社会各界讨论民间借贷问题时争论的焦点。利率保护上限过高不仅达不到保护借款人的目的，且存在信用风险和道德风险。但利率保护上限过低也可能会出现两个结果：一是借款人在市场上得不到足够的信贷，信贷供给出现紧缺，加剧资金供需紧张关系。二是民间借贷从地上转向地下，地下钱庄、影子银行可能更为活跃。为补偿法律风险的成本，民间借贷的实际利率可能进一步走高。

金融机构有接入征信的国家金融基础设施建设支持，但民间借贷暂时无法接入征信(除P2P因为行业清退原因)，本身违约惩戒手段就相对有限。另外，LPR是正规金融的利率锚，这块受央行货币政策的直接影响；民间借贷是传导来的间接影响，其市场利率有可能与正规金融利率走势背离。

进元财富认为此次规范的调整，司法保护的民间借贷利率大幅下调，实际利率已十分逼近城投平台非标融资产品，而城投平台非标融资产品属国资背景平台融资，安全性无疑较民间借贷高出不少。收益相近、安全性存在明显区别，作为个人投资者何不转投城投信托定融产品呢？
