信托理财产品与资产管理业务的区别

信托即受人之托，代人管理财物。是指委托人基于对受托人的信任，将其财产权委托给受托人，由受托人按信托照委托人的意愿以自己的名义，为受益人（委托人）的利益或其它特定目的进行管理或处分的行为。信托业务是由委托人依照契约或遗瞩的规定，为自己或第三者（即受益人）的利益，将财产上的权利转给受托人（自然人或法人），受托人按规定条件和范围，占有、管理、使用信托财产，并处理其收益。

资产管理业务是指资产管理人根据资产管理合同约定的方式、条件、要求及限制，对客户资产进行经营运作，为客户提供证券及其他金融产品的投资管理服务的行为。资产管理可以定义为机构投资者所收集的资产被投资于资本市场的实际过程。虽然概念上这两方面经常纠缠在一起，但事实上从法律观点来看，资产管理者可以是、也可以不是机构投资者的一部分。在国内资产管理又称作代客理财。

相同点：

1.项目发行方均为金融机构，都属于投融资平台，可以横涉资本市场、货币市场、产业市场等多个领域。

2.项目发行前必须报备相关监管单位，资金监管、信息披露等方面都有严格规定。 3.发行的项目本质相同通道不同，认购方式相同，项目合同、说明书等类似。 4.目前通过这两种方式取得的投资收益均无需代扣代缴个人所得税。

不同点：

1.信托公司由银监会监管，资产管理公司由证监会监管；

2.全国目前有68家信托公司持有银监会颁发的信托牌照，资产管理公司（均为基金公司旗下子公司，由证监会授予牌照）目前40余家；

3.信托募集结束，款项交至托管银行即可成立；资管计划募集完毕后，需交由证监会验资，验资完毕方可成立；

4.未来资产管理计划份额可通过交易所向其他投资者转让；信托份额转让需双方同时去信托公司办理。
