信托赔偿准备金是什么

摘要:信托作为四大金融机构之一，除了收到严格监管外还存在各类保护机制，信托赔偿准备金即使其中之一。

信托赔偿准备金指从事信托业务的金融企业按规定从净利润中提取，用于赔偿信托业务损失的风险准备金。国家《信托公司管理办法》规定：信托公司每年应当从税后利润中提取5％作为信托赔偿准备金，信托赔偿准备金累计总额达到公司注册资本的20％时，可不再提取。信托公司的赔偿准备金应存放于经营稳健、具有一定实力的境内商业银行，或者用于购买国债等低风险高流动性证券品种。这就意味着信托业今后要将注册资本的20%长期放在银行账面上，信托公司的注册资本金越大，要提取的信托赔偿准备金就越多。

国家《金融企业会计制度》规定了“从事信托投资业务的金融企业，应按本年实现净利润的一定比例提取信托赔偿准备，用于弥补亏损，不得用于分红、转增资本”，并且规定了其具体用途，“从事信托业务时，使受益人或公司受到损失的，属于信托公司违反信托目的、违背管理职责、管理信托事务不当造成信托资产损失的，以信托赔偿准备金赔偿”。

目前绝大部分信托公司从来都没有动用过信托赔偿准备金！

除了信托公司资金的信托赔偿准备金，国家还有什么保护措施？

1、《信托公司净资本管理办法》

第十六条 信托公司应当持续符合下列风险控制指标：

（一）净资本不得低于各项风险资本之和的100%；

（二）净资本不得低于净资产的40%。

2、《中国银监会办公厅关于信托公司风险监管的指导意见》

意见明确要求“信托公司股东应承诺或在信托公司章程中约定，当信托公司出现流动性风险时，给予必要的流动性支持”，以前兑付只是信托公司自己的事儿，现在连股东都要对兑付承担责任了。

3.信托业保障基金：信托业的保险

信托业保障基金是经国务院同意，中国银监会批准设立的银行业金融机，截止2018年底保障基金规模已经超过1500亿，通过保障基金的介入，可以换取风险缓释和化解的时间窗口，将单体项目和单体机构风险消化在行业内部。
