三方代销公司的返点靠谱吗？项目会不会有风险？

近年来，信托投资理财在我国发展迅猛。由于固定收益类信托具有“安全”的固有声誉，甚至还长期维持“刚性兑付”的神话光环，信托投资成为很多对风险较敏感的高净值客户群最钟爱的投资理财工具。

 

为了尽快把产品售出，信托公司支付给这些第三方理财机构销售费用；这也是第三方理财机构能够给客户提供返点的真正本钱。

 

不少投资人在认购信托时，越来越关心返点的力度；但是由于信息不对称，投资人往往难以了解信托返点的市场整体情况。

 

据了解，信托产品的返点，有高有低，根据投资方向的不同而不同。

 

警惕返点骗局，最好能签订书面协议

 

第三方理财机构的客户经理向投资人承诺高额返点，但最后却不能兑现的情况屡见不鲜。尤其是在一些运营成本较高、本来就没有足够盈利空间提供高额返点的公司更为常见。进元财富在这里提醒各位投资人，多数客户经理都有业绩考核压力，有时候他们会为了过关而不惜向投资人许诺无法支付的高额返点。

 

由于投资人获得认购返点，本来就是违反监管规定的事；加上信托认购流程特殊，一旦完成打款，基本不能够再退款，如果第三方理财机构赖账，投资人的权益很难得到保护。投资人要想确保自己的返点落在实处，最好还是能签订书面协议。目前，有部分公司可以为投资人出具书面的“返点确认协议”，但还是有新闻报道出现违约现象。

 

据了解，银监会曾在2011年下发《规范信托产品营销有关问题的通知》，要求信托公司在信托产品营销过程中“不得向投资者给予或承诺给予信托合同以外的不正当经济利益”。不过，一位研究信托法律的专家向记者表示，上述文件对第三方理财机构难以形成法律约束力。因此，双方可以签订书面协议，达成契约关系，这就相当于一个民事行为，投资人的权益受《合同法》保护，如遇违约可以追讨。我们进元财富就可以出具书面协议，售前让您明明白白，安心放心。
