信托设立那么高的门槛是为什么？

在很多投资者的眼里，信托比较稳健，收益也比一般的产品高，加之“刚性兑付”的潜规则，让投资者都愿意掏出百万资金用来投资，也使得信托投资范围维持在一个较高的水平，甚至一些人凑集亲朋友好友的资金一起来投资。

 

但是其实投资者还是需要对信托产品的条款仔细询问，比如风控的条款、投资项目的具体情况等，利用诸如凑钱、借钱等投资信托的行为不值得鼓励。

 

信托项目风险暴露而引发的投资者纠纷，现已不是什么新鲜事。作为一种具有较高风险和收益的投资方式，信托投资范围有着相应的门槛要求。信托是针对高净值人士的资产配置方式，它要求投资者具备一定的风险识别和承受能力。

 

设立门槛是为了“保护”

 

我国现代信托业恢复于1979年。“当时，信托更像是‘金融百货公司’。” “从最初的银行规避信贷计划管理的工具，到地方政府融资的渠道，信托公司的业务涉及委托投资、信托贷款、资金拆借、证券承销等多种业务。”

 

正由于信托公司的业务多而杂，且无明确定位，发展中才乱象丛生。随着2001年颁布实施《信托法》及2002年颁布《信托投资公司管理办法》、《信托投资公司资金信托管理暂行办法》，我国信托业明确了“受人之托，代人理财”的定位。当时规定，接受委托人的资金信托合同不得超过200份，每份合同金额不得低于人民币5万元，这是集合资金信托计划最初的信托投资范围门槛设定。

 

基于更好地保护投资者特别是个人投资者的利益，2007年，新“两规”即《信托公司管理办法》、《信托公司集合资金信托计划管理办法》实施，信托投资的门槛也从5万元提高到100万元。“随着高净值人群经济实力的提升，门槛以后可能还会提高。”李旸说，较高的门槛也意味着更高的风险承受能力。

 

不过，信托计划属于私募性质的高风险金融产品，社会大众对其风险认知度不高。现阶段，在信托公司自主发行能力较弱的背景下，银行等金融机构代销依旧是集合资金信托计划的主要募集方式。但因存在业绩导向等问题，代销过程中出现了违规推介、夸大宣传等行为。

 

因此，投资者需要对信托产品的条款仔细询问，比如风控的条款、投资项目的具体情况等。而且，凑钱、借钱等投资信托的行为不值得鼓励。随着信托风险的累积，以及自担风险的导向，万一项目出现风险，凑钱、借钱来投资信托，就会衍生出纠纷。信托公司应对投资者做好事前的警示和教育。
